Who we are Bramble & Eighth is the trading name of BRAMBLE AND EIGHTH LTD, a company registered in Scotland with company number SC903872 and its registered office at 138 MAIN STREET FK53JF. You can contact us at hello@brambleandeighth.co.uk
This policy explains your rights when you buy from us online at brambleandeighth.co.uk. It sets out your legal rights and does not reduce them.
Your right to cancel — 14 days, no reason needed Because you are buying at a distance (online), you have the legal right to cancel your order for any reason. You do not have to give us a reason.
- The cancellation period ends 14 days after the day the goods come into the physical possession of you, or of a person you have identified (other than the carrier) to take possession of them.
- If you ordered several items in one order and they are delivered on different days, the period ends 14 days after the day the last item comes into your physical possession.
- If your order consists of multiple lots or pieces delivered on different days, the period ends 14 days after the day the last lot or piece arrives.
- If your contract is for the regular delivery of goods over a period of more than one day, the period ends 14 days after the day the first goods arrive.
How to cancel Email hello@brambleandeighth.co.uk with your order number and tell us you wish to cancel. You may use the model cancellation form at the end of this policy if you prefer. To meet the deadline you only need to send us your cancellation before the 14-day period ends.
Returning the goods
- After telling us you wish to cancel, you must send the goods back without undue delay and in any event no later than 14 days after the day you told us.
- Please send returns to: SMITHFIELD, 138 MAIN STREET, LARBERT, SCOTLAND FK53JF.
- Who pays return postage: You are responsible for the direct cost of returning the goods.
- Please keep proof of postage. If you can show us you have sent the goods back, we must refund you within 14 days of that evidence, if that is earlier than us receiving the goods.
Refunds
- We will refund you without undue delay and in any event within 14 days of receiving the goods back, or (if earlier) within 14 days of the day you provide evidence of having sent them back.
- We refund all payments we received from you, including the standard delivery charge you paid. If you chose a delivery option costing more than our least expensive standard option, we refund up to the cost of that least expensive standard option.
- We refund using the same means of payment you used, unless you expressly agree otherwise.
- We do not charge you any fee for processing a refund.
- Handling and deductions: you are entitled to handle the goods as you would in a shop — for example, to try clothing on. If the value of the goods is reduced because you handled them beyond what is necessary to establish their nature, characteristics and functioning, we may deduct that amount, up to the price of the goods. We will not make any deduction if we failed to give you the required information about your right to cancel.
When the right to cancel does not apply The 14-day right to cancel does not apply to:
- goods made to your specifications or which are clearly personalised;
- goods which are liable to deteriorate or expire rapidly;
- sealed goods which are not suitable for return for health protection or hygiene reasons, once they have been unsealed after delivery;
- sealed audio or video recordings, or sealed computer software, once unsealed after delivery;
- newspapers, periodicals and magazines (other than subscription contracts);
- goods which become mixed inseparably with other items after delivery.
Faulty, damaged or misdescribed goods — your statutory rights These rights are separate from, and in addition to, your right to cancel. Nothing in this policy limits them.
- Short-term right to reject: if the goods do not conform to the contract — for example they are faulty, not as described, or not of satisfactory quality — you have 30 days beginning with the first day after delivery to reject them and obtain a full refund.
- Repair or replacement: after the 30-day period, if a fault appears you are entitled to have the goods repaired or replaced. If you request or agree to a repair or replacement, the 30-day period stops running while you wait. If the repaired or replacement goods still do not conform, you then have 7 days after the waiting period ends, or the original period extended by the waiting period, whichever is later.
- Price reduction or final right to reject: you may require a price reduction or reject the goods for a refund, but only one of the two, and only if: after one repair or one replacement the goods still do not conform; or repair or replacement is not possible; or we fail to repair or replace within a reasonable time and without causing you significant inconvenience. Where you exercise the final right to reject, any refund may be reduced to take account of your use of the goods, except that no reduction for use may be made if you reject within the first 6 months.
- First 6 months: if you return goods within 6 months of delivery, we must repair or replace them unless we can prove they were not faulty when we sold them. After 6 months, you may need to show that the fault existed at the time of purchase.
- Time limits for claims: in England, Wales and Northern Ireland you can bring a claim up to 6 years after purchase; in Scotland, up to 5 years.
- Warranties and guarantees: your rights are exactly the same whether or not you have a warranty or guarantee, and they continue even after a warranty or guarantee has expired.
- Proof of purchase: we may ask you for proof that you bought the item from us, such as a receipt, order confirmation, bank statement or the packaging.
- Returns by someone other than the buyer: we are only required to accept returns from the person who bought the item.
How to make a claim for faulty goods Email hello@brambleandeighth.co.uk with your order number, a description of the fault and photographs where possible. Please do not attempt to repair the goods yourself or arrange for someone else to do so, as this may affect your remedies.
Complaints If you are unhappy with your purchase or our service, please email hello@brambleandeighth.co.uk. We aim to acknowledge complaints within 14 working days and resolve them within 28 working days. We are not obliged to use an alternative dispute resolution (ADR) provider, and we do not currently do so. Nothing in this section affects your right to take a matter to court.
