1. Who we are This website, brambleandeighth.co.uk, is operated by BRAMBLE AND EIGHTH LTD, a company registered in Scotland with company number SC903872 and registered office at SMITHFIELD, 138 MAIN STREET, FK53JF SCOTLAND. 2. These terms These terms govern your use of our website and any purchase you make from us. By placing an order you agree to them. If you are a consumer, you have legal rights that these terms cannot and do not take away. Please save or print a copy of these terms for your records.

3. Our products

  • We describe our products as accurately as we can. Colours and textures may appear differently depending on your screen and device.
  • Our products are supplied and dispatched by third-party suppliers. The brand name shown on a product is the supplier's brand, not ours.
  • Product availability is not guaranteed until we confirm your order.

4. Ordering

  • The steps to place an order are: add items to your basket; proceed to checkout; enter your delivery and payment details; review your order; and place the order.
  • You can correct any errors before placing your order using the basket and the checkout review screens.
  • The total price, including delivery charges, is shown before you pay.
  • Placing an order is an offer to buy. Our order confirmation email is our acceptance of that offer, and a contract is formed at that point. We may decline an order if an item is out of stock, if there is an obvious pricing error, or if we suspect fraud.
  • We will confirm the contract in writing, by email, as soon as possible and no later than when the goods are delivered.

5. Price and payment

  • Prices are shown in pounds sterling (GBP) and are inclusive of VAT.
  • We accept payment by major credit and debit cards. Payment is taken at checkout.
  • We may change our prices at any time, but price changes will not affect orders we have already accepted.

6. Delivery Delivery, processing times, delivery costs and our 30-day delivery commitment are set out in our Shipping & Delivery Policy at /policies/shipping-policy.

7. Your right to cancel As a consumer buying online, you have a 14-day right to cancel most purchases. Full details — including how to cancel, the deadlines, who pays return postage and the goods to which the right does not apply — are set out in our Refund & Returns Policy at /policies/refund-policy.

8. Faulty or mis-described goods Your statutory rights under the Consumer Rights Act 2015 apply to everything you buy from us. These include the 30-day short-term right to reject, the right to repair or replacement, and the right to a price reduction or final rejection in the circumstances described in our Refund & Returns Policy at /policies/refund-policy.

9. Our liability to you

  • We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
  • We are responsible for loss you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if it was contemplated by both of us when the contract was formed.
  • We are not responsible for loss that was not foreseeable, and we are not liable for business losses such as loss of profit or loss of business opportunity. These terms are intended for consumers.
  • Our total liability in connection with any order is limited to the amount you paid for that order, except where the law does not permit such a limit.

10. Intellectual property All content on this website — including text, photographs, graphics, logos, and the Bramble & Eighth name and branding — belongs to us or our licensors. You may not copy, reproduce, distribute or use it without our written permission.

11. Acceptable use You agree not to misuse this website, including by attempting to gain unauthorised access to it or its systems, scraping or harvesting its content, introducing viruses or other harmful material, or using it for any unlawful purpose.

12. Reviews and user content By submitting a review, comment or other content, you confirm that it is genuine, that it reflects your honest opinion, and that you have not been incentivised to leave it. You grant us a licence to display, reproduce and edit it for the purpose of promoting our products. We will not publish fake, incentivised or misleading reviews, and we will not suppress genuine negative reviews.

13. Data protection and cookies We handle your personal data in accordance with our Privacy Policy at /policies/privacy-policy and our Cookie Policy, which explain what data we collect, why we collect it, and your rights.

14. Complaints and governing law If you have a complaint, please email hello@brambleandeighth.co.uk. We will try to resolve it promptly. We are not obliged to use an alternative dispute resolution (ADR) provider, and we do not currently do so. These terms are governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction, except that if you live in England, you may bring proceedings in the courts of your own country.

15. Changes to these terms We may update these terms from time to time. The version that applies to your purchase is the version published at the time you place your order.
